USPTO Name Search
A USPTO search, or a search of the United States Patent and Trademark Office’s database, is the first step in the trademark registration process. This search will help you determine if your proposed trademark is already registered or pending registration with the USPTO. If a similar trademark is already registered, you may be denied registration of your proposed trademark. Additionally, a USPTO search can help you identify any potential legal issues that may arise with your proposed trademark, such as the likelihood of confusion with another trademark.
WIPO/ Country Searches
A WIPO search, or a search of the World Intellectual Property Organization’s database, is also an important step in the trademark registration process. This search will help you determine if your proposed trademark is already registered or pending registration with other international trademark offices. This is important because if your proposed trademark is already registered in another country, it may be denied registration in the United States.
Local Name Search
A local business name search is necessary because even though your trademark may not be registered with the USPTO or WIPO, it may still be in use by a local business. Keep in mind that local does not necessarily mean small. There are many large local businesses that have little or no online presence but may have a long history of doing business in their respective areas. By conducting a local business name search, you can identify any potential legal issues that may arise with your proposed trademark, such as the likelihood of confusion with another established business or trademark.
